Data Privacy – Transfer – DLA Piper’s pioneering data transfer methodology

Transfer has been developed by DLA Piper’s global data privacy team to help streamline the conduct of transfer impact assessments (TIAs) following the Schrems II decision. Assessments  are now required to be carried out on a case by cases basis under the GDPR whenever personal data are transferred from Europe or the UK to a ‘third country’.

There are three key components to Transfer :

  • A proprietary ‘five-step’ assessment methodology with supporting scorecard designed to help conduct standardised assessments consistent with the judgment and current regulatory guidance. Firms are free to use the methodology as is, or integrate with existing compliance solutions (eg OneTrust).
  • Country specific analysis. Developed in conjunction with local counsel this provides ‘essential equivalence’ assessments to the privacy and surveillance laws in over 60 countries worldwide.
  • Front end “tool”, allowing users to quickly complete and record assessments consistent with the principles of accountability in the GDPR.

Transfer has been shortlisted by ‘The Lawyer’ and ‘FT Legal Innovation Awards’ in recognition of the way it operationalises legal risk management, supported with country-rich content and a legal tech solution.
