The government is seeking views on how to abolish section 21 of the Housing Act 1988. This allows private landlords to remove tenants for any reason, provided they have been given two months? notice. To compensate for the removal of Section 21, the government is seeking views on how to strengthen the law and mechanisms for Section 8 evictions, which allow a landlord to end a tenancy provided an appropriate reason is given. We responded on behalf of our members active in buy-to-let mortgage lending. While we support measures which enhance trust between landlords and tenants, we caution that the removal of Section 21 can only be successful if the government is committed to (1) expanding the grounds which can used under Section 8; (2) allowing for accelerated possession in more circumstances, particularly when mortgage lenders need to take possession; and (3) providing sufficient resources to the court system so the increased eviction caseload can be accommodated when Section 21 is removed.
